    My husband and I purchased a home through Presidential Mortgage in Nov 2019. During the inspection and appraisal process there was an exposed septic discovered. We also discovered at that time all the copper pipes had been stolen. The condition report said the home was on public sewer. The appraiser said it was an abandoned septic and as a condition of our loan, required we fill the hole. After we moved in the plumbing started to back up. Our realtor notified Presidential Mortgage on Jan 2nd of the issue. No one from their office ever contacted us until we contacted them in March to try to find a resolution. We had to do a lot of leg work to find the best solution and wanted to have all the information so we could come to a resolution. After contacting Presidential Mortgage we basically got the run around. The verbatim quote from Scott Whittle was "I have an ethical duty that my clients be able to use the product they purchased." There was a lot of talk about helping and they kept us dangling for about a month. Finally, I spoke with the VP today, Jim Round, and was told that they don't feel they have any liability so they aren't going to do anything. He said he felt sorry for us and was trying to find a solution. I really hate being lied to. His next sentence was they don't have any liability so they aren't going to help. That they self reported to FHA that the company financed a home that did not qualify under FHA standards but they aren't at fault. They only self reported after we talked in March and we told the lender we were going to file a complaint with FHA. They also only looked at their risk/reward possibilities. Since they felt they had little liability, they don't see a benefit to do the right thing. An exposed septic should have been enough for the appraiser to request a sewer inspection from the city. This is from the HUD/FHA handbook sent directly from a FHA representative. When is an inspection required for a sewage disposal system? The Appraiser must require an inspection to ensure that the system is in proper working order if there are readily observable signs of system failure. If additional inspections, repairs or certifications are noted by the appraisal or are required to demonstrate compliance with Property Acceptability Criteria, the Mortgagee must obtain evidence of completion of such inspections, repairs or certifications. The Mortgagee must confirm that a connection is made to a public or community sewage disposal system whenever feasible and available at a reasonable cost. If connection costs to the public or community system are not reasonable, the existing onsite sewage disposal systems are acceptable provided they are functioning properly and meet the requirements of the local health department. When the onsite sewage disposal system is not sufficient and an off-site system is available, the Mortgagee must confirm connection to an off-site sewage system. When the onsite sewage disposal system is not sufficient and an off-site system is not available, the lender must reject the property unless the onsite sewage disposal system is repaired or replaced and complies with local health department standards. This was our first home buying experience and it was not the experience we were hoping for. We trusted them to look out for our best interests and they did not. They were glad to take our money, but didn't care enough to ensure the home was fit. We are now paying a mortgage on a home we can not live in, in fact it is illegal to live in.
